Terms of Service

These Terms of Service ("Terms") govern your use of https://www.palmarsoccer.com and the soccer training and related services provided by Palmar Elite Soccer LLC ("Palmar," "we," "us," or "our"). By using our website, purchasing a service, or enrolling a player, you agree to these Terms. A parent or legal guardian must accept these Terms and complete all required enrollment documents for a minor player.

1. Services

Palmar provides youth soccer Performance Assessment Days, individual and small-group training, memberships, soccer camps, video analysis, Palmar On Tour programs, and related player-development services. Program descriptions, schedules, locations, availability, eligibility requirements, and pricing may vary and will be disclosed on the website, during enrollment, or in a separate written offer. Published information does not guarantee availability or acceptance into a program.

2. Eligibility and Enrollment

Only a parent, legal guardian, or adult expressly authorized by the parent or legal guardian may enroll a minor player. The enrolling adult confirms that the information provided is accurate and that they have authority to make enrollment, health, emergency, payment, and consent decisions for the player. Enrollment is limited and may depend on age, current level, development needs, program fit, safety considerations, and availability. Palmar may decline or defer enrollment when reasonably necessary.

3. Memberships, Recurring Billing, and Cancellation

Unless stated otherwise in writing, memberships continue month to month and are billed automatically on a recurring monthly basis. Before enrollment, Palmar will disclose the exact recurring fee, the first payment amount and date, and the recurring billing date. By enrolling, the payer authorizes Palmar and its payment provider to charge the selected payment method until the membership is canceled.

Membership fees cover four occurrences of each scheduled weekly session per monthly billing cycle. If a scheduled training day occurs a fifth time within the billing cycle, that additional session is not included.

Palmar will provide at least 30 days' advance written notice before increasing a recurring membership fee. A membership may be canceled at any time through the available online cancellation method or by emailing billing@palmarsoccer.com. Cancellation must be submitted before the next scheduled charge to prevent that charge. Unless required by law or stated in Section 4, cancellation takes effect at the end of the current paid billing period, and fees are not prorated or refunded.

An initial membership may be canceled in writing within three business days after the membership agreement is signed. A timely cancellation under this paragraph will receive a refund within 30 days. Palmar may suspend services for a failed or overdue payment after reasonable notice.

4. Cancellations, Missed Sessions, Program Changes, and Refunds

General Cancellation Rules. The following rules apply to all cancellations, alongside the service-specific terms below:

  • All deadlines are based on the scheduled start time in U.S. Eastern Time.

  • A cancellation is considered received once it reaches Palmar through the booking system or by email.

  • In the case of sudden illness or a genuine emergency, Palmar may grant an exception at its sole discretion. This does not create any entitlement to future exceptions.

  • If Palmar cancels a Membership session, it will be made up or credited.

  • If Palmar cancels a service or program and does not offer a suitable replacement, the amount paid for the portion not provided will be refunded.

  • For weather-related cancellations or a significant shortening of a session, Camp, or other program, a suitable replacement will be offered first. If that is not possible, a proportional credit or refund will be provided for the portion not delivered.

  • Unless a different statutory timeline applies, approved refunds are returned to the original payment method within 10 business days.

Individual Training Sessions. Individual Training Sessions may be rescheduled once if Palmar receives notice at least 24 hours before the scheduled start time. The rescheduled session must take place within 30 days and is subject to availability. A rescheduled session cannot be rescheduled again. Cancellations made less than 24 hours in advance and no-shows are not eligible for a refund, credit, or make-up session and, where applicable, count as a used Membership session.

Group Membership Sessions. If a player is unable to attend, Palmar must be notified at least 24 hours before the scheduled session. Subject to availability, Palmar may offer the player a place in another suitable group session within 30 days. Make-up sessions are provided at Palmar's discretion and are not guaranteed. Participant absences are not eligible for a refund or credit. Cancellations made less than 24 hours in advance and no-shows are not eligible for a make-up session.

Small-Group Drop-Ins. Small-Group Drop-Ins may be rescheduled once within 30 days if Palmar receives notice at least 24 hours before the scheduled session. Rescheduling is subject to availability, and the replacement session cannot be rescheduled again. Cancellations made less than 24 hours in advance and no-shows are not eligible for a refund, credit, or make-up session.

Palmar Performance Assessment Day. Registrations may be cancelled for a full refund at least seven days before the scheduled Performance Assessment Day. Cancellations received between 72 hours and fewer than seven days in advance may be transferred once to a later Performance Assessment Day, subject to availability. Cancellations made less than 72 hours in advance and no-shows are not eligible for a refund or credit. If the Performance Assessment Day was included in an Elite Membership, it will be considered used.

Soccer Camps. Cancellations made at least 14 days before the Camp start date are eligible for a full refund. Cancellations made between seven and 13 days before the Camp start date are eligible for a 50% refund. Cancellations made fewer than seven days before the Camp start date and no-shows are non-refundable. A Camp registration may be transferred to another eligible player only with Palmar's prior written approval.

Video Analysis. Video Analysis bookings are eligible for a full refund until Palmar begins reviewing the submitted footage or preparing the analysis. Once work has begun, the fee is non-refundable.

Local Team Training. A single local Team Training booking may be rescheduled once if Palmar receives notice at least 72 hours in advance. Rescheduling is subject to availability. Cancellations made less than 72 hours in advance and no-shows are non-refundable and are not eligible for credit. Larger or multi-session Team Training programs are subject to the cancellation terms stated in the applicable written proposal.

Palmar On Tour. A non-refundable deposit of 30% of the total booking price is required to reserve a Palmar On Tour booking. The remaining balance is due 14 days before the first scheduled date. If the customer cancels at least 14 days in advance, payments made above the deposit will be refunded, less any non-recoverable third-party costs already incurred. Cancellations made fewer than 14 days in advance are non-refundable. Additional booking-specific terms may be included in the written proposal.

Free Evaluation. Players should provide at least 24 hours' notice if they cannot attend a Free Evaluation. No cancellation fee applies. Following a no-show, another Free Evaluation may be offered subject to availability but is not guaranteed.

5. Player Health, Assumption of Risk, and Required Participation Waiver

Soccer training and related athletic activities involve physical exertion and inherent risks, including contact with other participants, equipment, playing surfaces, weather, and accidental injury. The parent or legal guardian is responsible for determining whether the player is able to participate and for providing accurate health, allergy, medication, emergency-contact, and other safety information. Palmar personnel do not provide medical advice.

Before participating, the parent or legal guardian must sign Palmar's separate Participation and Liability Waiver and any required Medical and Emergency Authorization. These Terms are not a substitute for those documents. Palmar may prevent participation when required forms are incomplete or when participation presents a reasonable safety concern.

6. Code of Conduct and Safeguarding

Players, parents, guardians, guests, coaches, and staff must act respectfully, follow reasonable safety instructions, and avoid bullying, harassment, discrimination, threats, violence, unsafe conduct, or disruption of training. Parents and legal guardians are responsible for timely drop-off and pickup and for following location and supervision rules.

Palmar may issue a warning, remove a person from a session, suspend participation, or end enrollment when reasonably necessary to protect participants, staff, or program operations. Safeguarding or conduct concerns may be reported to safety@palmarsoccer.com. An immediate danger should be reported to emergency services first.

7. Video Recording, Performance Analysis, and Media Use

Certain Memberships, Performance Assessment Days, camps, or video-analysis services may include recording by Veo or other performance tools for coaching, player feedback, and internal service delivery. The applicable service description or enrollment documents will identify when this is included.

Promotional use of a minor player's name, image, voice, photo, or video requires a separate, optional Parent Media Release signed by a parent or legal guardian. Agreeing to these Terms or the Privacy Policy does not provide promotional consent, and declining promotional consent does not affect program eligibility. A parent or legal guardian may withdraw promotional consent prospectively by writing to privacy@palmarsoccer.com, although withdrawal may not apply to materials already lawfully produced or distributed.

Parents, players, and guests may not record or publicly share identifiable images or footage of other minor participants without appropriate permission.

8. Intellectual Property and Permitted Use

The Palmar website, branding, training materials, Performance Assessment Day formats, Palmar Development Plans, Performance Reviews, reports, graphics, photos, videos, and other original content are owned by Palmar or used with permission. Families may use materials provided specifically for their player for personal, non-commercial development purposes. They may not copy, sell, publish, distribute, modify, or use those materials commercially without prior written permission.

Third-party names, trademarks, club names, league names, and product names belong to their respective owners. References for identification or factual description do not imply sponsorship, endorsement, partnership, or affiliation unless expressly stated.

9. Disclaimers, No Guarantee of Results, and Limitation of Liability

Player development depends on many factors, including attendance, effort, health, prior experience, team environment, and opportunities outside Palmar's control. Palmar does not guarantee a particular improvement, team selection, starting position, scholarship, academy placement, college opportunity, professional contract, or other result.

To the fullest extent permitted by law, Palmar is not liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Physical-activity risks and related releases are addressed separately in the signed Participation and Liability Waiver.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before filing a claim, the parties should send written notice to legal@palmarsoccer.com and attempt in good faith to resolve the dispute informally for at least 30 days. Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court with jurisdiction in Sarasota County, Florida. Either party may pursue an eligible matter in small-claims court.

11. Changes to These Terms, General Provisions, and Contact Information

Palmar may update these Terms from time to time. The Effective Date at the top identifies the current version. Material changes will apply prospectively, and when appropriate Palmar will provide notice on the website or by email.

If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms, together with applicable enrollment, payment, waiver, and consent documents, form the agreement for the matters they address. If a signed program-specific document conflicts with these Terms, the signed document controls for that specific matter.
